Terms of Service.

1. Who we are
Hosted Proof is operated by Hosted Brands LLC, a Michigan limited liability company. Contact: hostedbrands@gmail.com.
2. The service
Hosted Proof (the "Service") lets you upload before/after photos, generate AI-assisted captions, and publish branded social posts to Google Business Profile, Facebook, and Instagram accounts you connect via OAuth. The Service is provided on a monthly subscription basis at the tiers published on hostedproof.com/#pricing.
3. Your account
- You must be 18+ and legally able to enter a contract.
- You're responsible for keeping your password safe. Share PINs with techs only as much as the workflow requires.
- You're responsible for ensuring the social accounts you connect are accounts you have authority to publish to.
4. Your content
You own everything you upload to Hosted Proof — your photos, your captions, your scheduling metadata. You grant us a limited, non-exclusive license to store, transform, and publish that content on your behalf via the connected platforms, solely to provide the Service.
You're responsible for ensuring that:
- You have the right to publish the photos you upload (e.g., customer consent where required, no protected health information, no images of minors without parental consent).
- The captions and content comply with each platform's policies (Google Business Profile content policy, Facebook community standards, Instagram community guidelines).
- You do not use Hosted Proof to post spam, fake reviews, fake testimonials, or misleading content.
5. Acceptable use
You may not use Hosted Proof to:
- Post content that's illegal, infringing, defamatory, harassing, or that violates third-party rights.
- Post to social accounts you don't have authority to publish to.
- Mass-post, spam, or otherwise abuse connected platforms in ways that violate their terms.
- Scrape, reverse-engineer, or attempt to extract source code from the Service.
- Resell or white-label the Service without a written agreement.
6. AI-generated content
Hosted Proof generates caption drafts using AI. Drafts are starting points — you review and approve every post. You're responsible for the final content that goes out under your business's name. We make no warranty that AI-generated captions will be accurate, error-free, or suitable for your specific business.
7. Connected platforms
Your use of Google Business Profile, Facebook, and Instagram through Hosted Proof is also governed by those platforms' terms of service. We are not responsible for platform-side outages, API changes, account suspensions, or policy enforcement actions taken by Google or Meta.
8. Billing
- Subscriptions billed monthly via Stripe.
- The Growth plan includes a 14-day free trial; the Starter plan starts paid.
- Cancel any time from your account — cancellation takes effect at the end of the current billing period.
- No refunds for partial months. If we made a mistake, email us and we'll make it right.
9. Termination
You can cancel any time. We can suspend or terminate accounts that violate these terms, especially in the case of platform-policy violations, abusive behavior, or non-payment. We'll give you a chance to fix the issue first when reasonable.
10. Disclaimers
The Service is provided "as is" and "as available." We don't warrant uninterrupted, error-free operation, that AI captions will be perfect, that platform APIs will behave consistently, or that posts will always succeed on the first attempt. We will, however, work hard to keep all of those true.
11. Limitation of liability
To the fullest extent permitted by law, Hosted Brands LLC is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits or revenues, arising from your use of the Service. Our total cumulative liability in any 12-month period will not exceed the amount you paid us in that period.
12. Indemnification
You agree to indemnify and hold harmless Hosted Brands LLC from claims arising from your content, your use of the Service, or your violation of these terms or third-party rights.
13. Governing law
These terms are governed by the laws of the State of Michigan, USA. Disputes will be heard in the state or federal courts of Kent County, Michigan.
14. Changes
We may update these terms. Material changes will be announced to active users at least 14 days in advance. Continued use after a change means you accept the new terms.
